Trade My Holiday – Terms and Conditions

Welcome to Trade My Holiday! These Terms and Conditions ("Terms") govern your use of the Trade My Holiday platform (the “Platform”), which facilitates the resale of travel bookings such as flights, hotel reservations, package holidays, and similar travel-related services.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About Trade My Holiday

Trade My Holiday is a marketplace that connects users who wish to sell unwanted travel bookings with buyers looking for travel deals. We are not a travel agency, airline, or tour operator. We do not own or manage any of the travel services listed on our site.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use our Platform. By registering or using our services, you represent and warrant that you meet these requirements.

3. User Accounts

  • You must register an account to buy or sell on the Platform.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and current information.
  • Trade My Holiday reserves the right to suspend or terminate accounts that violate these Terms.

4. Listings and Transactions

Sellers:

  • You may only list travel bookings that are legally transferable and that you have the right to sell.
  • You are responsible for the accuracy of your listing, including dates, locations, and any restrictions.
  • You agree to promptly transfer all necessary documents to the buyer after a successful sale.

Buyers:

  • You understand that bookings are sold “as-is” and may have limitations or restrictions set by the original provider.
  • It is your responsibility to check that the booking can be transferred and meets your needs before purchasing.

Trade My Holiday does not guarantee the transferability of any booking and is not responsible for denied transfers or entry.

5. Fees and Payments

Payments are processed through Stripe, a third-party payment processor. By using our Platform, you also agree to be bound by Stripe’s terms and conditions:

Trade My Holiday may charge a service fee to buyers and/or sellers, which will be clearly stated at checkout.

6. Refunds and Cancellations

All sales on Trade My Holiday are final unless:

  • The seller fails to provide valid documentation within 48 hours after purchase.
  • The travel service provider explicitly denies the transfer (with proof).

In such cases, buyers may be eligible for a refund at Trade My Holiday’s sole discretion. Refunds are not provided for change-of-mind purchases or user errors.

7. Prohibited Conduct

You agree not to:

  • List fraudulent, non-transferable, or misrepresented bookings.
  • Attempt to manipulate pricing, feedback, or the platform’s operation.
  • Violate any laws or third-party rights.

8. Limitation of Liability

Trade My Holiday is not liable for:

  • Booking issues, restrictions, or cancellations imposed by original providers.
  • Losses arising from miscommunications between buyers and sellers.
  • Indirect, incidental, or consequential damages.

Our total liability to you for any claim arising from use of the Platform is limited to the amount you paid to Trade My Holiday (if any) in the past 12 months.

9. Dispute Resolution

In the event of a dispute between users, Trade My Holiday may assist in mediating but is not obligated to resolve disputes. For unresolved issues, both parties agree to attempt to resolve the matter amicably before pursuing legal action.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes constitutes acceptance.
